CLAUSES OF PROGRAMME AND PROGRESS



工期总日历天数： 天。工期总日历天数与根据前述计划开竣工日期计算的工期天数不一致的，以工期总日历天数为准。

The total calendar days for work: days. In case of inconsistency between total calendar days with the scheduled days from commence to completion, the total calendar days will be prevail.



Progress Reports进度报告

Unless otherwise stated in the Particular Conditions, monthly progress reports shall be prepared by the Contractor and submitted to the Employer in six copies. The first report shall cover the period up to the end of the first calendar month following the Commencement Date. Reports shall be submitted monthly thereafter, each within 7 days after the last day of the period to which it relates.

除非专用条件中另有规定,承包商应编制月进度报告,一式六份,提交给雇主.第一次报告所包括的期间,应自开工日期起至当月的月底止.以后应每月报告一次,在每次报告期最后一天后7日内报出.



“进度计划”是指承包商根据第12.1款提交的进度计划以及任何批准的对进度计划的修订。

"Programme" means the Programme to be submitted by the Contractor in accordance with Sub-Clause 12.1. and any approved revisions thereto.



在合同或进度计划规定的时间内，可能用于合同和进度计划的图纸、样品、模型或资料，并按规定的份数；

within the time given in the Contract or in the Programme such drawings, samples, models or information as may be called for therein, and in the numbers therein required, and

The Contractor shall submit to the Engineer for his approval the Programme which shall contain the following:



承包商应在开工日期之后28天内按序言规定的格式提交进度计划。

The Contractor shall submit the Programme in the form stated in the Preamble within 28 days after the Commencement Date.



工程师对该进度计划的批准不应解除合同规定的承包商或业主的任何义务。

The approval by the Engineer of the Programme shall not relieve the Contractor or the Employer from any obligation under the Contract.



修改进度计划

Revision of Programme

如果工程的进展不符合进度计划时，工程师可指示承包商修改进度计划。如果要求作出上述修改的原因不是由承包商负责时，工程师应为编制修改的进度计划之费用开具证明，并将之加到合同价格中。

If the progress of the Works does not conform to the Programme, the Engineer may instruct the Contractor to revise the Programme. If such modifications are required for reasons for which the Contractor is not responsible, the cost of preparing the revised Programme shall be certified by the Engineer and added to the Contract Price.



若在任何时候承包商的实际进度落后于第4.14款所指明的进度计划，或很明显将落后于该进度计划，则承包商应向雇主代表提交一份考虑到当前情况的修订的进度计划。承包商应同时将正在采取的为加快施工进度，以便在竣工时间内完工的步骤通知雇主代表。

If, at any time, the Contractor’s actual progress falls behind the programme referred to in Sub-Clause 4.14, or it becomes apparent that it will so fall behind, the Contractor shall submit to the Employer’s Representative a revised programme taking into account the prevailing circumstances. The Contractor shall, at the same time, notify the Employer’s Representative of the steps being taken to expedite progress, so as to achieve completion within the Time for Completion.



Programme

The Contractor shall submit a programme to the Employer’s Representative, for information, within the time stated in the Appendix to Tender. The programme shall include the following:

进度计划

在投标书附录中规定的时间内，承包商应向雇主代表提交一份进度计划，供其参考。进度计划应包括下列内容；



（a）承包商计划实施工程的次序（包括设计、采购、制造、货物运达现场、施工、安装、检验和试运行的各个阶段）；

(a) the order in which the Contractor proposes to carry out the Works (including each stage of design, procurement, manufacture, delivery to Site, construction, erection, testing and commissioning),



（b）施工文件编制中包含的所有主要事件与活动；

(b) all major events and activities in the production of Construction Documents,



（c）根据第5.2款进行施工前审查的期限以及在雇主的要求中规定的其他提交、批准和同意的期限；

(c) the periods for the pre-construction reviews under Sub-Clause 5.2 and for any other submissions, approvals and consents specified in the Employer’s Requirements, and



（d）合同中规定的所有检验的次序。除合同另有规定外，此类进度计划的编制应采用前导网络技术，标出最早开始、最迟开始、最早结束、最迟结束的日期。

(d) the sequence of all tests specified in the Contract. Unless otherwise stated in the Contract, the programme shall be developed using precedence networking techniques, showing early start, late start, early finish and late finish dates.



不论雇主代表何时要求，承包商均应以书面形式提供一份为实施工程承包商计划采用的安排和方法的总体说明，供其参考。在未通知雇主代表的情况下，进度计划或此类安排与方法都不应有重大更改。若工程进展与进度计划不符，雇主代表可通知承包商修改进度计划，指出为在竣工时间内完成工程须作的必要更改。

The Contractor shall, whenever required by the Employer’s Representative, provide in writing, for information, a general description of the arrangements and methods which the Contractor proposes to adopt for the execution of the Works. No significant alteration to the programme, or to such arrangements and methods, shall be made without informing the Employer’s Representative. If the progress of the Works does not conform to the programme, the Employer’s Representative may instruct the Contractor to revise the programme, showing the modifications necessary to achieve completion within the Time for Completion.



进度报告 Progress Reports

承包商应编制月度进度报告，并将6份副本提交给雇主代表。第一份报告所包含的期间应从开工日期起至开工日期所在月历的最后一天止，此后每月均应在该月最后一天之后的14日内提交月度进度报告。报告应持续至承包商完成了工程移交证书上注明的、完工日期时尚未完成的所有工作为止。每一份报告应包括：

Monthly progress reports shall be prepared by the Contractor and submitted to the Employer’s Representative in six copies. The first report shall cover the period up to the end of the calendar month after that in which the Commencement Date occurred; reports shall be submitted monthly thereafter, each within 14 days of the last day of the period to which it relates. Reporting shall continue until the Contractor has completed all work which is known to be outstanding at the completion date stated in the Taking-Over Certificate for the Works. Each report shall include:



向甲方代表提供工程进度计划及收款计划；

To provide construction progress and payment schedule to Party A’s representative;



进度计划 Progress schedule

乙方应按合同条款约定的日期，将施工组织设计和工程进度计划提交修改意见，逾期不确认也不提出书面意见的，视为同意。

Party B shall raise advice on amendments to the construction design program and progress schedule to Party A as per the agreement, if any; if no request for amendment is made as of the stipulated deadline, it shall be regarded Party B has agreed on the construction design program and progress schedule.



乙方必须按甲方代表确认的进度计划组织施工，接受甲方代表对进度的检查、监督。工程实际进度与经确认的进度计划不符时，乙方应按甲方代表的要求提出改进措施，经甲方代表确认后执行。因乙方的原因导致实际进度与进度计划不符，乙方无权就改进措施提出追加合同价款。

Party B shall organize for construction as per the progress schedule approved by Party A’s representative and accept the inspection and supervision of Party A’s representative; in case of any discrepancy between the actual progress and the approved progress schedule, Party B shall propose remedy measures as per the requirement of Party A’s representative an implement such measures if approved. In case the discrepancy is caused by Party B, Party B shall have not right to charge any additional contract value regarding the remedy measures taken.



工程的设计和建造由C实施。每月的第 ____天(如遇节假日顺延)，C应向B提出基于上一个月的土建和工程的进度报告，这种报告应是证明公正性的结论性证据，但明显计算错误除外。

Design and Construction of the Project shall be executed by C. At onthly intervals until ____day (subject to postponement in case ____)of each month， C shall execute a statement of a claim for progress payment based on the prices for the construction works done in he preceding month to B and such statement shall be the conclusive vidence proving fairness of such claim except manifest calculation error.



提交在合同规定的时间内进度计划 Programmer to be Submitted

承包商应当在中标函签发日之后，以工程师规定的适当格式和详细程度， 向工程师递交一份工程进度计划，以取得工程师的同意。无论工程师何时需要，承包商还应以书面形式提交一份对其进行工程施工所拟采用的安排和方法的总说明，以供参考。

The Contractor shall, within the time stated in these Conditions after the date of the Letter of Acceptance, submit to the Engineer for his consent a programme, in such form and detail as the Engineer shall reasonably prescribe, for the execution of the Works. The Contractor shall, whenever required by the Engineer, also provide in writing for his information a general description of the arrangements and methods which the Contractor proposes to adopt for the execution of the Works.



无论何时，如果工程师认为，工程的实际进度不符合第34.1款中已经同意的进度计划时，承包商应根据工程师的要求提出一份修订过的进度计划，表明为保证工程按期竣工而对原进度计划所作的修改。

If at any time it should appear to the Engineer that the actual progress of the Works does not conform to the programme to which consent has been given under Clause 34.1, the Contractor shall produce, at the request of the Engineer, a revised programme showing the modifications to such programme necessary to ensure completion of the works within the Time for Completion.

Article 35 Cash Flow Estimate to be Submitted.



To inspect the construction progress and quality; to inspect and accept the divisional, sub-divisional and concealed works; to evaluate the construction progress

检查工程进度和施工质量,验收分部分项工程和各项隐蔽工程, 对工程进度进行评估。每周书面向委托人报告工程进度，每周组织召开施工例会。



参加甲方组织的施工图纸或作法说明的现场交底，拟定施工方案和进度计划，交甲方审定。

attend the construction diagram paper or method that the first party organizes explanatory of hand over bottom on the scene, project and progress of the draw-up construction plan, hand over the first party to approve officially.
